
The club receives a significant number of claims involving ‘people’, whether these are crew, passengers or third parties. We estimate that 30% of all claims received would fall into this category, which is second only to cargo claims. These claims are therefore significant and have a high financial value.
The majority of the ‘people’ claims received will be crew illness or injury claims, though we also have a relatively large exposure to passenger claims from our cruise and ferry operator members.
The issues which would fall into the category of ‘people claims’ are too numerous to list in full, but some of the most relevant in recent years are
the Ebola outbreak, the introduction of the Maritime Labour Convention (and its forthcoming amendments), the amendments to the Athens Convention, and the ongoing crisis of migrants/refugees crossing the Mediterranean.
There are also regular legal developments in many jurisdictions (particularly the Philippines and UK) which are relevant to the claims we receive and on which we seek to provide updates.
