As previously explained, the PLR gives effect to the key provisions of the Athens Convention Relating to the Carriage of Passengers and their Luggage by Sea 1974 as amended by the 2002 Protocol.
The club previously issued a circular on 6 December 2012 notifying members of the entry into force of Regulation (EC) No 392/2009 of the European Parliament and of the Council of 23 April 2009 on the Liability of Carriers of Passengers by Sea in the Event of Accidents (the “PLR”). This supplemented by a circular dated 24 September 2012 providing information in respect of the PLR and the insurance and certification requirements.
As previously explained, the PLR gives effect to the key provisions of the Athens Convention Relating to the Carriage of Passengers and their Luggage by Sea 1974 as amended by the 2002 Protocol (the “Convention”). A significant feature of the PLR is that it also extends the provisions of the Convention to certain categories of passenger ships engaged in domestic seagoing voyages.
Members should be aware that Norway has now implemented Regulation 392/2009 and that this will come into force in Norway from 1 January 2014. In this regard, it is understood that the full insurance requirements of the PLR will apply to Class A and B vessels engaged in domestic traffic from this date. The Club’s circular of 24 September 2012 provided definitions for both Class A and B vessels.
The rapid implementation of the PLR in Norway leaves members very little time to adjust to the new requirements. The club therefore advises members who operate ships in Norway to be fully aware of the insurance requirements the PLR imposes.
